1. Introduction to the FridgeDoor Privacy Policy
1.1 FridgeDoor provides a Push Notification service (“FD Service”) that allows you to create, send and manage messages to the mobile phone numbers of your recipients via www.fridgedoorapp.com (the “FD Website”). Recipients can manage these messages using the Fridgedoor App (the “FD App”).
1.2 “FridgeDoor" means FridgeDoorapp Limited, a New Zealand registered company (Company Number 6095253) with registered office and principal place of business at Level 6, 57 Courtenay Place, Wellington, 6141 , New Zealand. Any notices you may wish to serve on FridgeDoor must be served to its registered office.
1.3 These Terms and Conditions of Use (“Terms”) and the FridgeDoor Privacy Policy (found on the FD Website) govern the use of the FD Service by any person. You agree to these terms by signing up to an account with FridgeDoor, or using the FD Service, or by installing, downloading or accessing the FD Website or the FD App.
1.4 For the purposes of these Terms, reference to the “FD Service” shall also include the FD Additional Services (as defined below), FD Website and FD App, as applicable.
1.5 The terms “you” or “your” refer to the person signing up to an account with FridgeDoor and the person using the FD Service and any other services that may be offered by FridgeDoor from time to time. You agree that your introduction to the FD Service may be by you receiving TXT messages or E-mails or Phone calls from any merchant, Company, organisation, club or 3rd party provider.
1.6 If you create an account on behalf of any other person, organisation or Company, you warrant that you have the authority to do so. Any person, organisation or Company that uses the FD Service warrants that they are authorised to do so and to send messages to those phone numbers. This authorisation must comply with relevant laws and any internal organisation or company policy that may be applicable.
1.7 We may amend or modify these Terms at any time and will keep you informed by posting the updated Terms and a notice of the changes on the FD Website at www.FridgeDoorapp.com. You are responsible for ensuring that you are familiar with the latest Terms at all times.
2. The Information We Collect and How We Use it
2.1 Aggregate Information
We monitor the use of the FD Service by collecting aggregate information through the use of cookies (see paragraph 3.3 about cookies). Typically, we collect information about the number of visitors to the FD Website, to each page and the originating domain name of the visitor's Internet Service Provider. This information is used to understand the visitor's use of the FD Service and may be shared within FridgeDoor and with other third parties to assist us in improving the FD Service. We have no means reasonably available to us to ascertain the identity of individual Users from the aggregated information.
2.2 Personal Information
(a) If you register to use the FD Service then you will be required to complete an on-line form which requires personally identifiable information about you, such as your name, e-mail address, business, phone numbers, country of residence and other information which you voluntarily submit. By submitting this information (together with any other information you may submit from time to time) you consent to this information being collected, used, disclosed, stored and processed by Fridge Door in accordance with this Privacy Policy and our Terms.
(b) You acknowledge that we may store your User Content (as defined in the Terms), and the associated templates and message data. This data can be used by recipients to communicate back to you via the FD Website or via usage of an API.
(c) If the push notifications you send using the FD Service are received and stored by users of the FD App then Fridge Door may collect information about when your data is opened or read and other user interaction with that data. This is to provide you with website functionally to monitor who has and hasn’t processed your push notifications.
(d) We intend to continue improving the content and functionality of the FD Service and in particular the customer experience. Therefore, we may collect information about how you use the FD Service, using cookies and other similar technologies. We may also monitor customer traffic patterns and site usage to help us to improve the design and layout of the FD Website and FD App, to personalise your experience by tailoring the content you see and optimising your user experience. This will further allow us to keep you informed of FridgeDoor products and services, or promotional campaigns which we may communicate to you through notifications on the FD Website or by email.
(e) Your personal information will be used in connection with the FD Service, including to enable us to undertake financial transactions with you such as invoicing, and ensuring we properly comply with any applicable legal, tax, industry or regulatory obligations.
(f) FD will also use your personal information to:
(i) communicate with you regarding your account with FridgeDoor or your use of the FD Service, or to send system alerts about changes to fees, services or features, or our general system support.
(ii) ensure or enforce compliance with our Terms or to meet legal requirements in the event of any proceedings in court, or mergers, or sale or acquisition of FridgeDoor.
2.3 User Content
(a) Your User Content is not, under any circumstances, used by FridgeDoor in any event whatsoever except as may be required by law or as stated in this Privacy Policy or the Terms. FridgeDoor will never contact phone numbers on your User Content lists, market to, sell, or share any User Content entered by you and stored by FridgeDoor.
(b) FridgeDoor will sometimes interrogate and view your User Content to verify compliance with our Terms. This could be done with software or by having employees or outside contractors analyse your data.
2.4 Promotion of Services
FridgeDoor may use your personal information as stated in this Privacy Policy and the Terms, regardless of whether you are using the FD Service, to promote the FD Service and any FD Additional Services to you.
2.5 Credit Card Information
If you choose to pay for the FD Service by credit card, your credit card details may not be held by FridgeDoor. When you submit your details they could be transmitted directly to a secure billing and payment collection service.
2.6 Opting Out of Communications you Receive from FridgeDoor
If you receive emails or notifications about the FD Service, any FD Additional Services, our products or promotional campaigns and you wish to opt out of receiving such information, then you can do so by sending an e-mail to support@fridgedoorapp.com Please use the words “Email Opt Out” in the subject line of the email and clearly state your username and any other relevant detail in the body of the email.
3. Protection of your Information
3.1 FridgeDoor Security Policies
FridgeDoor have in place appropriate security policies which are intended to ensure, as far as reasonably possible, the security and integrity of all information held by them in connection with the FD Service, including your personal information. FridgeDoor may securely store your information in New Zealand or in any other country with FridgeDoor may from time to time offer the FD Services. Your personal information may, therefore, be transferred outside of New Zealand.
3.2 Use of Passwords
If you are a registered user of the FD Service, access to your account will be controlled by a username and password. To prevent unauthorised access to the FD Website, you should choose a strong password and keep it confidential from others. It is your responsibility to ensure any Authorised Persons (as defined in the Terms) maintain similar security standards.
3.3 Cookies
FridgeDoor uses Internet Protocol (IP) addresses to analyse trends, administer the FD Service, track your use and gather broad information for aggregate use. Our web servers may also send cookies to your browser to track navigation history and ensure transaction pages, such as 'shopping cart' interactions, work correctly. Cookies contain only coded information that cannot be used by third parties to access your information. Most internet browsers allow you to adjust settings to erase cookies, disallow cookies, or receive a warning before a cookie is set. Please note that some parts of the FD Service may not function properly if your internet browser is set to disallow cookies.
3.4 Disclosure of Information
Unless expressly authorised to do so by you, and subject to Clause 2 herein, FridgeDoor will not disclose any User Content or personal information about a User to any third party except where the disclosure relates to the purposes for which the information was collected.
4. Terms & Conditions of Use
Use of the FD Website is subject to the Terms which can be found on the FD Website. This Privacy Policy should be read in conjunction with the Terms. In the event of a conflict or disagreement between this Privacy Policy and the Terms, the Terms will prevail.
5. Access, Updates, Feedback & Concerns
At any time you may request to see the personal information that FridgeDoor holds on your behalf or to correct or update any personal information (to the extent that you are unable to do so on the FD Website). 6. Retention of Information
FridgeDoor may hold your information both before and after the cancellation of your account, but only for as long as FridgeDoor is lawfully entitled to do so.
